PRESCRIPTION BAG PROGRAM AGREEMENT by and between freerxbags.com hereinafter referred to as Marketer, and participating pharmacy, hereinafter referred to as Pharmacy, hereby agrees to be the distribution point for six to twelve months for 6,000 to 24,000 pharmacy bags.
SECTION ONE
Marketer hereby agrees to furnish Distribution Point with pharmacy bags at no cost whatsoever to Pharmacy.
Bags will be drop shipped to Pharmacy from Marketer’s printer. Pharmacy hereby agrees to distribute said bags
to customers as they purchase and/or fill prescriptions.
SECTION TWO
Marketer shall sell advertising space on the bags to local area businesses. Marketer also agrees to allow Pharmacy
to proof all art work and advertising prior to printing. If Pharmacy fails to respond to Marketer’s bag proof for a
period of 10 days it is hereby agreed that such non-action will be construed as acceptance that the bag proof is
acceptable and Marketer may proceed to print. If marketer, for any reason, is unable to sell ad space to merchants,
marketer may choose not to furnish bags and will refund, in full, any and all merchants that have purchased an ad.
SECTION THREE
Pharmacy or Marketer may choose not to renew agreement for any reason. If after bags are delivered to Pharmacy, Pharmacy or Marketer wishes not to renew the agreement for any reason, Pharmacy or Marketer agrees to give 30 days written notice.
SECTION FOUR
No other warranties implied or otherwise than what is expressed herein and in writing have been made. This
agreement is to be interpreted and construed under the laws of Florida.
